§ 1 SCOPE OF APPLICATION
Our following general terms and conditions apply to the delivery and sale of our goods to consumers and all other purchasers.

However, the provisions shall only apply to customers who are not consumers on the condition that the right of withdrawal described in more detail in Section 8 shall not apply.

General terms and conditions deviating from these are only valid if they have been expressly agreed with us.

§ 2 CONCLUSION OF THE CONTRACT
Orders from our shops are forwarded to our shopping cart system on daintydystopia.de .

First, you select the items you want from our online shop by placing them in the virtual shopping cart. Before submitting your order, you have the opportunity to review and verify your previous order details. At this point, you can identify and correct any input errors.

You submit your order by clicking the "Buy Now" button. You will then be redirected to your chosen payment option, where you can pay for your goods.
We will confirm receipt of your order, which represents an offer to conclude a purchase agreement with us, by email. The received order will be confirmed by a separate email (order confirmation), thereby creating a legally binding contract between you and us.

§ 3 NATURE AND ESSENTIAL CHARACTERISTICS OF THE GOODS
The nature, characteristics and quality of the delivered goods are determined by the information contained in the respective product descriptions, which are available on our website daintydystopia.de .

§ 4 UNAVAILABILITY OF THE GOODS
The contract is concluded subject to the retention of our own supply; this reservation applies to consumers only if we have concluded a specific hedging transaction and are not supplied by the supplier through no fault of our own. We will inform the customer immediately of the unavailability of the goods and promptly reimburse any consideration provided by the customer.

§ 5 PRICES, DELIVERY AND PAYMENT TERMS
All prices quoted include 19% VAT. For international transfers, the foreign transaction fees (transfer fees) are the customer's responsibility.

Items that are in stock are usually dispatched within 1-3 business days. We ship exclusively with DHL; the goods take 1-4 days to arrive. If the item is not in stock when ordered, we will notify the customer immediately.

The prices valid at the time of ordering are derived from the respective product descriptions published on our website and are shown separately for each order before it is sent.

Payment for the goods is made using one of the payment service providers listed on daintydystopia.de .

Shipping costs are to be borne by the customer and are updated under a separate menu item "Payment, Shipping & Returns" and are available there at any time.

§ 6 WARRANTY
Our warranty obligation is governed by statutory provisions. We do not provide any guarantee of quality or durability.

§ 7 RIGHT OF WITHDRAWAL
You have the right to cancel your order within two weeks. Details can be found in the separate cancellation policy.

The right of withdrawal does not apply to goods specially manufactured to the customer’s request.

The right of withdrawal expires at the latest 6 months after receipt of the goods.

§ 8 RESERVATION OF TITLE
The delivered goods remain the property of DAINTY DYSTOPIA until full payment has been made.

§ 9 DATA STORAGE AND DATA PROTECTION
We treat all personal data collected from you with the strictest confidentiality. The data necessary for the execution of the contract will be stored and processed electronically to the extent necessary for the processing and execution of the contract.

§ 10 COMPENSATION
In the event of a breach of a contractual obligation by us that is neither intentional nor grossly negligent, liability is limited to typical, foreseeable damages.

The above limitation of liability shall not apply if a breach of a contractual obligation affects life, body, or health. Furthermore, the limitation of liability shall not apply if the customer asserts product liability claims.

§ 11 COPYRIGHTS AND OTHER RIGHTS
DAINTY DYSTOPIA holds the exclusive copyright, trademark, and other rights, as well as general rights of use, to all text, graphics, photographs, logos, designs, and the coordination and arrangement of all content on daintydystopia.de. Unless expressly permitted in writing by DAINTY DYSTOPIA, content on daintydystopia.de may not be copied, reproduced, uploaded, downloaded, publicly displayed, otherwise published, or otherwise distributed or appropriated in any way.

§ 12 APPLICABLE LAW
All deliveries are subject exclusively to the laws of the Federal Republic of Germany.

§ 13 JURISDICTION AND OTHER PROVISIONS
Our registered office shall be the place of jurisdiction if the contract is concluded with a merchant or if the customer does not have a general place of jurisdiction in the Federal Republic of Germany.

Should individual provisions of this contract be invalid, this shall not invalidate the entire contract. The invalid provision shall be replaced by the corresponding statutory provisions.
